IP Kat published an article by Vanessa Delnaud of the Dubai office of Gowling WLG regarding the copyright protection in United Arab Emirates.
One of the interesting facts about this legislation is that it is much closer to the French one than to UK one, which in turn set a number of special features some of which are:
- rights over works created by employees or independent contractors can be transferred only through written agreements, where it should be specified explicitly the purpose for the assignment of the rights, what exactly rights are transferred, the term and the territory;
- it is not possible to transfer copyrights over works which will be created in the future;
- it is nor possible the moral author’s rights to be transferred, however, the author can undertake in writing not to exercise his rights, provided that an agreement specifies the work and specific uses to which the undertaking applies;
